InboundFlip™ — InboundFlip™
Effective: June 20, 2026Contents
These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (or the entity you represent, “Applicant”) and InboundFlip™ (“Company,” “we,” “us,” or “our”), governing your access to and use of the InboundFlip™ platform (inboundflip.cloud), including the Vendor Engineering Evaluation Portal (collectively, the “Services”).
By checking the acknowledgment box on the application form, submitting an application, or completing payment, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
The InboundFlip™ Vendor Engineering Evaluation Portal is a structured intake system through which development agencies and technology vendors may formally submit credentials for consideration in connection with engineering projects undertaken by or on behalf of InboundFlip™.
The Services provide:
The Services do not constitute an offer of employment, an offer to contract, a solicitation of bids under any procurement statute, or a commitment to engage the Applicant for any project or service.
A non-refundable administrative review fee of $20.00 USD is required to initiate formal evaluation of a submitted application. This fee covers the cost of engineering review time, credential verification, and administrative processing. Payment is processed securely by Stripe, Inc.
The fee is earned upon (a) successful payment and (b) our receipt of a complete application as described in Section 4. Once earned, it will not be refunded, including but not limited to on account of:
Refund exceptions. Notwithstanding the above, we will refund the fee if: (a) you were charged more than once for the same application in error; (b) payment was captured but no application was actually received by us; (c) we fail to perform the review described in Section 4 within sixty (60) days of a complete application, through our own fault and not yours; or (d) a refund is required by applicable law or by the rules of our payment processor that cannot be waived by agreement. To request a refund under this paragraph, contact privacy.assurance@gmail.com with your application ID; we will respond within ten (10) business days.
In the event of a payment dispute or chargeback, we may provide Stripe and/or the relevant payment network with records of your application, submission, and these Terms to show the basis on which the fee was charged. Nothing in this Section limits any right you have under applicable law or under your card issuer's or payment provider's own dispute procedures.
Payment of the administrative review fee and submission of a complete application entitles you to the following review process: (1) confirmation that your application and payment were received; (2) a check of your submission against the credentials and case study you provided; and (3) an internal assessment by a member of our technical team of whether your submission, as presented, appears to meet our current evaluation criteria. This process, and not any particular outcome, is what the fee pays for. It does not guarantee:
The Company retains full and sole discretion over all procurement decisions, including whether to contact, shortlist, engage, or decline any Applicant.
By submitting an application, you represent and warrant that:
You represent and warrant that all information submitted through the Vendor Engineering Evaluation Portal is true, accurate, current, and complete to the best of your knowledge. Submission of false, misleading, or fabricated information — including inflated case studies, false client references, or misrepresentation of technical capabilities — is grounds for immediate disqualification and forfeiture of any review fee paid. The Company reserves the right to verify submitted credentials through independent means.
You agree not to:
The Company reserves the right to block, suspend, or take legal action against any Applicant engaging in prohibited conduct.
All content, design elements, software, and materials comprising the Services, other than content submitted by Applicants, are the property of InboundFlip™ or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services solely for the purpose of submitting a vendor application.
By submitting an application, you grant InboundFlip™ a non-exclusive, royalty-free license to use, review, store, and share (internally) the content of your application for the purpose of vendor evaluation. You retain ownership of the content you submit.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA.
IN NO EVENT SHALL THE COMPANY’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE AMOUNT PAID BY YOU IN ADMINISTRATIVE REVIEW FEES IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless InboundFlip™ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) any false or misleading information you submitted; or (d) your violation of any rights of another party.
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles.
12.1 Informal resolution first. Before filing an arbitration, the party bringing a claim must send the other party a written notice describing the dispute and the relief sought, to privacy.assurance@gmail.com (for notices to us) or to the email address on the application (for notices to you). The parties will attempt in good faith to resolve the dispute informally for thirty (30) days after such notice is sent. Either party may bring an individual claim in small claims court in lieu of arbitration if the claim qualifies for that court's jurisdiction.
12.2 Binding arbitration. Any dispute arising out of or relating to these Terms or the Services that is not resolved under Section 12.1 or brought in small claims court shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, including the Expedited Procedures where the amount in controversy is below the threshold set by those rules, as they exist at the time the arbitration is commenced. A single arbitrator shall be appointed under AAA's rules. Unless the parties agree otherwise, the arbitration hearing (if any) will be conducted remotely by videoconference or telephone; either party may request an in-person hearing in New Mexico under AAA's rules.
12.3 Fees and costs. Payment of filing, administrative, and arbitrator fees will be allocated as required by the AAA rules then in effect and by applicable law. Nothing in this Section requires you to bear a share of costs greater than what applicable law permits.
12.4 Class action waiver; severability. Claims must be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request must be severed and heard in court, and all remaining claims and requests remain subject to arbitration under this Section.
12.5 Mutuality. This Section binds both you and us equally; either party may initiate the informal-resolution process or, thereafter, arbitration.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION RELATED TO THESE TERMS OR THE SERVICES.
The Company reserves the right to modify these Terms at any time. We will indicate the effective date of any revision at the top of this page. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of those changes. We recommend reviewing this page periodically.
